Smith, 362 N.C. 469, 665 S.E.2d 737 (2008), a case of first impression in North Carolina, where our Team expertly established the enforceability of limitation of liability provisions in design professional contracts. We also effectively limited indemnity in the context of construction to parties with express indemnity contract provisions with Kaleel Builders v. Ashby. 358 N.C. 235, 595 S.E.2d 152 (2004).
