Melanie Raubach

Ms. Raubach works within several of HSSM’s practice groups dealing with corporate issues. Her experience ranges from representation in zoning and regulatory issues to leading complex litigation and appeals. The most substantial portion of her practice focuses on the representation of parties dealing with insolvency and collection issues — in bankruptcy cases, receiverships, foreclosures, and collection actions.

Ms. Raubach has represented debtors-in-possession through every stage of the Chapter 11 process, culminating in many confirmed plans of reorganization. She has dealt with the assumption and rejection of commercial leases and negotiation of settlements over cure amounts. She has negotiated settlements and litigated issues to their resolution, including preference, fraudulent transfer, and avoidance actions in jurisdictions throughout the United States.

Ms. Raubach has significant experience within Subchapter V reorganization cases. She serves as a Subchapter V Trustee in the Western District of North Carolina and was one of the first debtor’s attorneys within the state of North Carolina to successfully confirm a Subchapter V plan of reorganization. Her case materials have been presented as illustrative materials for use in Subchapter V cases, and she has spoken at legal seminars on the topic of Subchapter V cases. She is a co-author of the “Subchapter V” section of the current North Carolina Bankruptcy Manual.

On behalf of creditor clients involved in bankruptcies, her collection work has included motions for relief from the automatic bankruptcy stay, objections to discharge, objections to plans of reorganization, and motions to dismiss bankruptcy cases. Outside of the bankruptcy context, Ms. Raubach has successfully prosecuted cases resulting in multi-million dollar recoveries for her creditor clients.

Ms. Raubach serves on the panel of Chapter 7 Trustees in the Western District of North Carolina. Ms. Raubach also frequently acts as counsel for Chapter 7 bankruptcy trustees. In that role, she has handled common motions like motions for relief from stay and motions to assume or reject leases. She has also led the arguments for novel legal issues, resulting in news coverage by national publications.

She acts as counsel in receivership actions. She was one of the first attorneys within the State of North Carolina to appear in a case arising from the now-current receivership statutes, which went into effect in 2021.
