Mr. Quick has been a civil litigation attorney for nearly 40 years. During his career he has litigated and tried cases in state and federal courts throughout the country, including those in North Carolina, South Carolina, Tennessee, Virginia, West Virginia, Kentucky, Georgia, Louisiana, Alabama, Mississippi, Arkansas, Florida, Texas, Illinois, and Connecticut.
For 30 years Mr. Quick has practiced in the large loss property subrogation area and has represented numerous property insurance companies. He has handled complex multi-party cases involving fire losses, water and flood-related losses, catastrophic structural failures, defective products, and construction deficiencies. A unique feature of his practice is his “initial involvement” in a loss. He is available immediately after his clients are notified of a new loss to assist in and help guide the investigation to determine the cause of the loss. He has a large database of forensic experts and consultants to recommend for all type losses. These experts are technically proficient and excel at articulating their findings and opinions through deposition or trial testimony. Mr. Quick recognizes that the prompt recognition of, and action on, matters with subrogation potential are absolute prerequisites to securing the maximum recovery of each insurer’s claim dollars.
In addition to his expertise in property subrogation cases, Mr. Quick has handled other cases in the products liability and construction areas. He opened the Charlotte office of Cozen O’Connor in 1990, where he was a senior partner and practiced for 16 years; and he formed the law firm of Quick, Widis & Nalibotsky in 2006.
Prior to practicing in Charlotte Mr. Quick practiced civil litigation law in Nashville, TN. He litigated commercial and entertainment cases involving writers, musicians, actors, production companies, broadcasters, and publishers. He handled major copyright and trademark infringement lawsuits and prosecuted and defended libel and other defamation lawsuits. He frequently lectured on First Amendment topics.
Experience
- Successfully represented the Head Coach of the Carolina Panthers, his wife, and their homeowner’s insurance company in a case resulting from a fire that destroyed the Coach’s residence.
- Lead counsel in a Mississippi case involving the collapse of a 2,000-foot high telecommunications tower that resulted in three fatalities and was caused by the improper replacement of structural diagonal members in the tower.
- Lead counsel in a fire case at a large sawmill operation in North Carolina. The fire spread throughout the entire sawmill building due to a sprinkler system that failed to operate properly.
- Lead counsel in a Tennessee case in which a fleece-producing plant was destroyed by fire. Successfully tried the case in federal court and obtained a seven-figure verdict. Prevailed in the appeal by defendant to the United States Court of Appeals for the Sixth Circuit seeking to reverse the verdict.
- Lead counsel in a South Carolina case in which a large home on Kiawah Island was destroyed by a fire that originated in the homeowner’s vehicle, which had been defectively repaired by a local dealership.
- Lead counsel in a North Carolina case involving a fire that destroyed the home of a dentist and was caused by a defective lithium ion battery in a laptop computer.
- Lead counsel for The Oak Ridge Boys in a major copyright infringement case brought by the legendary songwriters Jerry Leiber and Mike Stoller, in which they alleged that the song “Bobbie Sue” constituted an unlawful infringement on their song “Yakety Yak.”
- Lead counsel in a multi-party Virginia case involving a tower crane that fell on an adjacent apartment complex. The collapse was caused by defective anchor stools that attached the crane to its base.
- Lead counsel in an Illinois case that involved a national distributor/retailer’s negligent failure to maintain its distribution facility property, which caused catastrophic flooding of an adjoining hospital.
- Lead counsel for a major insurance company in conjunction with the flooding of downtown Nashville, Tennessee and the surrounding area as a result of the overflow of the Cumberland River. Worked with numerous hydrological and civil engineers and meteorologists to determine the cause of, and responsibility for, the flooding.
