  • Becky focuses her practice on construction and land use, with an emphasis on litigating in these areas.

    In her construction practice, Becky has broad experience representing all parties in the construction chain, but her most recent experience focuses on defending design professionals and municipal owners. Her recent representative experience includes:

    • Leading the defense of the City of Charlotte from a general contractor’s claim for $110,000,000, which arises out of construction of the federally-funded streetcar system through downtown Charlotte. The matter is pending in North Carolina Business Court.
    • Obtaining a defense verdict for a design professional after a 2-week jury trial in state court. The plaintiff was a large healthcare provider who alleged professional negligence, as well as unfair and deceptive trade practices.

    Outside of the courtroom, Becky negotiates and drafts construction agreements and dispute settlements. By way of example, she previously negotiated and drafted the RFQ and contract documents for the construction manager at risk for a $58 million renovation and expansion of a public water system.

    On the land use side, Becky handles eminent domain litigation, property tax appeals, nuisance suits, and zoning review and litigation. Recently, she successfully fought a large development planned for the Myers Park and Eastover neighborhoods, resulting in the developer’s withdrawal without litigation. She has defended farmers and poultry processors from agricultural nuisance suits, litigated subdivision approvals and rezonings through the courts of appeal, and represented municipalities in condemnations for large public projects.
