HSSM attorney Melanie Raubach has been selected to co-author the next edition of the North Carolina Bankruptcy Manual. Ms. Raubach will be helping to draft the new “Subchapter V” section. Subchapter V of Chapter 11 of the Bankruptcy Code first became effective in February 2020. Subchapter V is sometimes referred to as the “Small Business Reorganization Act”. The provisions were adopted to facilitate the confirmation of bankruptcy plans of reorganization for small business debtors and for certain individuals. Ms. Raubach served as debtor’s counsel in one of the first successfully confirmed Subchapter V cases in North Carolina. Since that time, Ms. Raubach has also participated in Subchapter V cases as counsel for secured creditors, as counsel for unsecured creditors, and as the Subchapter V Trustee.
