HSSM attorneys Keith Merritt, Becky Cheney and Melanie Raubach won a case before the North Carolina Court of Appeals last week on behalf of long-time firm client, the City of Kannapolis. HSSM convinced the appellate court that the plaintiffs’ case—a challenge to a local rezoning—was properly dismissed. The case Wally v. City of Kannapolis concerned allegations of spot zoning, which is a complex issue of land use. As argued in HSSM’s brief, the Court of Appeals held that, under the precedent set by Musi v. Town of Shallotte, the City of Kannapolis had not engaged in spot zoning.
